RICHMOND, Va. – The rock band Phish is asking a federal judge to block the sale of bootleg merchandise at its upcoming reunion concerts in Hampton, Va.

A hearing is scheduled for Thursday in Newport News on the band's request for an injunction that would bar the sale of unauthorized T-shirts, posters and other items bearing the Phish name.

The band, which broke up in 2004, is starting a reunion tour Friday with the first of three concerts at Hampton Coliseum.

Phish says in court papers that it's had trouble with bootleggers in the past. The band wants police to seize any unlicensed Phish merchandise being sold near the coliseum. Phish also is seeking unspecified damages against the unidentified defendants.

That's pretty bad-ass... Hard to believe Hampton is in two days...

they need to play some of these shows in movie theaters like they did last time around. that was fun

Free download is nice but the merch nazis are on the march...Phish, which racked up $175.5 million in concert revenues since 1989, wants to stop bootleggers from selling T-shirts, jackets, bumper stickers and other merchandise bearing its trademarked name. Phish had been one of the highest grossing tour bands for 20 years until the group disbanded in 2004. That year, the band earned about $20 million in tour revenues.

This is lame...How much is enough??? This is nothing new though, while waiting to get into Coventry I saw them take hundreds of shirts from kids at the gates. I usually buy something from the "offical" merch tent usually the Pollack tour poster, but shirts and such are outragous at that tent and since I paid out the yin-yang to get to the show, buy tix and score a poster I probably have bought some bootleg stuff...That being said, that is how many kids make their money instead of selling dope. Whats the big deal? Hundreds of millions not enough? Plaaaaalease!

To a degree, I'm glad they're coming down on the lot rats. That was a big piece of the whole scene falling apart. And while I love Waldo (hope to see him there too), his court fight did not endear the Phish camp to copyright offenders. Pretty easy to sell stuff that doesn't say "Phish" on it, there's lot's of room to still play...

I understand the band not wanting "PHISH" on unliscensed merch. Most lot shirts don't say "PHISH". So, it seems that the problem in minimal.

Putting The OM In Community

As most of you are probably well aware, all three upcoming Hampton Coliseum shows are completely sold-out. If you don't have tickets to a particular show, we ask that you please refrain from going to the venue in hopes of getting one. Even if no ticketless fans show up, sold-out Phish shows in communities like Hampton are high impact events that strain the normal daily flow. Add ticketless fans to the equation and the situation can quickly become overwhelming to the local community. Thanks in advance for respecting the Phish scene.

I dont really see the lot police as a greed thing. If you dont have the money to go dont go. If you dont have a ticket dont go. Phish does not want more bans in citys & venues across the country. I wish it was like the old days too. But its not.

All of you people who are hating on t-shirt vendors and calling us lot rats must have never been to a Phish show. When I used to follow Phish around I was going to school and had a full time job. I would take a month off from work during our summer break and follow around the band that I love selling t-shirts a long the way (ME NO ARE NO NICE GUY Scarface shirts to be exact). I was even stopped at Deer Creek and had my shirts examined, but because there were no tourdates, the words Phish or various song titles, or any of the band members likenesses they were returned to me. Screenprinting, as well as the graphic design involved, is a fine art and while I may not agree with the band's decision about unauthorized vending, I respect where they are coming from. JUST BECAUSE A PERSON SELLS T SHIRTS ON TOUR DOES NOT MAKE THEM A LOT RAT. People who come to the shows only to cause trouble, get wasted, sell fake garbage, sell real garbage, take advantage of people etc. and who have no interest in the band or their music are lot rats. GET IT RIGHT OR DONT COME!!!!!!!!!!!! Your hate is not welcome!!!

Scarphase, I agree completely with you. In the late winter/spring (about now) I start making products to sell when we are on the road, not just in parking lots of shows, or festival grounds, but whenever wherever. Its a great way to go places you want, and for people to enjoy home made products instead of corporate things. We make things like soap, shirts, rugs, and candles.

That's cool, but having all 3 nights on PPV and sending out free sass to everybodys houses would be much better.

On another note, I think it is a good idea to cut down and the touring crowd...that way a bunch of dirty ticketless wooks don't ruin Red Rocks again and get 'em banned a second time. Don't go if you don't have tickets.

And DJ3452, Phish definitely should do that. I like to see a "CNN Exit Poll" of Hampton patrons asking the price they paid for their tickets.

what i'm wondering is how hampton will do to ticket prices for the june tour. Will prices just raise more if they are on fire - will they drop if they're par / sub-par? It will be interesting as so much trading / ticket attention has been given to the hampton weekend that once it's over all that attention will shift to the other shows.....maybe those knoxville tickets will be worth more hahahah one can only wish...

It amazes me how mean and negative jamband fans can be sometimes. I'm grateful for the free music that is boing given to us by the band. I have a feeling they are going to play some historical shows this weekend. Wish I could be there to be part of it. I'll be in Asheville for sure, paid a lot for my ticket, glad I got one. I don't care if Phish members have drug problems are not, those boys can jam.

I saw them for the 1st time in '99 at VA Beach,l guess I'll see them again in a few tours when noobs stop clogging the ticket channels.
